Courts Martial and 39 Park Square Chambers

The Courts-Martial team at 39 Park Square is one of the most successful and experienced in the country. We offer genuine expertise in what we regard as a discrete and specialized area of practice.

All of our team understand the requirements and realities of service life; the structure of the Armed Forces and the Chain of Command. Most importantly we recognise the need to gain the trust of the soldier, airman or marine who may be more used to following orders than giving instructions.

As soon as we are involved we will arrange a meeting so that we can explain what is happening and the timescale of future events. We will provide personal mobile telephone and e-mail contact details so that any questions can be answered quickly and easily. We will never ask you for any form of payment. We will never charge additional amounts for our travel or accommodation or for additional meetings. All of our fees are covered by the Armed Forces Criminal Legal Aid Scheme.

Members of the team have secured ‘not guilty’ verdicts in courts-martial where the allegations have included rape, historic sexual abuse, sexual assaults, wounding and violent disorder. We have also dealt successfully with cases of absence without leave, assault and other Army and Air Force Act offences as well as Summary Appeals.

We have also been involved in a number of high profile cases.

Two members of the team uncovered a systematic and historic failure of pre-deployment training for the T.A.  They forced the disclosure of material from HQ Land and HQ AG and, by showing that the T.A. had been deployed without proper training, secured a verdict of not guilty for a Lance Corporal charged with the manslaughter of his Troop Sergeant in Iraq. What was uncovered not only saved the Lance Corporal from a jail sentence but also ensured that training to the standard demanded by Army Operational Shooting Policy was re-instated and the likelihood of future fatalities was reduced.

We also represented one of the leading defendants in the case dealing with the shipping of guns back from Iraq to Germany. The allegation was that they were then supplied to the German underworld or sold within the British Army. Our client was the only one to be completely cleared of all charges.

In the process we have appeared at Military Court Centres in Northern Ireland, Cyprus, Germany, Bulford, Colchester and Catterick.
